California's Zone 0 rules for the first five feet around a home are expected back in front of the State Board of Forestry and Fire Protection this week. The Board is scheduled to meet November 4 and 5 in Sacramento. State staff say they will ask members to approve edits made after the package was pulled back from the Office of Administrative Law (OAL). No statewide Zone 0 rule is in effect today.
What happened so far
On August 19, 2026, the Board of Forestry unanimously adopted the Zone 0 regulations, according to the Mountain Democrat. The Board sent the package to OAL on August 28, and OAL's short public comment period closed on September 2, according to a legal summary from Public CEO.
Then the package was withdrawn from OAL review. Wildfire Los Angeles, a community group tracking the rule, reported on September 11 that the withdrawal was procedural. It said the Board wanted to address technical edits and questions before resubmitting, and that no timetable had been given at that point.
Marcie Thompson, a land use planning program manager with the Board, told the Mountain Democrat the withdrawal was not a repeal. She said the revised package is expected to come back to the Board on November 5, and members will be asked to approve the changes. After that, it goes back to OAL. In her estimate, the soonest the rule could take effect is the very end of November or early December. The Board's published schedule says meeting dates are subject to change, so check the agenda before you count on that timing.
What Zone 0 would require
Zone 0 is the ember-resistant area within five feet of a building, including attached decks and stairs. Law firm BBK summarizes the adopted text this way:
- Roofs and gutters stay clear.
- Vegetation and combustible items are removed from beneath decks, balconies, pergolas and stairs.
- No firewood is stored in the zone.
- New combustible fencing is prohibited in the zone, and fencing that attaches to or nearly touches a structure generally needs a five-foot noncombustible section.
- A small outbuilding under 120 square feet can sit in the zone only if it is made entirely of noncombustible materials.
- Limited, maintained, nonwoody plants may be allowed in parts of the zone if they meet height, spacing, area and container standards.
Where the rules apply depends on who has jurisdiction. BBK reports the amended State Responsibility Area rules apply to buildings throughout those areas, whatever the parcel's hazard rating. The Local Responsibility Area rules apply only to occupied structures in locally designated Very High Fire Hazard Severity Zones, not across Moderate or High zones.
When would you have to comply?
The timeline is staggered. The Mountain Democrat reports that once approved, the rules take effect right away for new residential construction, and existing properties get time to make changes. The Public CEO summary adds that state law delays the new-structure requirements until the Board updates and posts its fuels-management guidance, which the Board has up to a year to do. It also says the requirements for existing structures start three years after the effective date for new structures. Separately, the Board's task force describes a phased approach for existing homes, with local jurisdictions setting timelines within five years for items such as an under-eave zone, gates, sheds and fencing.
In short, nothing here creates a compliance deadline for your home this week. The final text, the guidance document and your local fire authority will set the real dates.
What Zone 0 does not do
Wildfire Los Angeles makes a point worth repeating. Zone 0 focuses on combustible materials and plant arrangements near the structure. It does not, by itself, make vents ember resistant, replace vulnerable windows, upgrade an older roof or enclose exposed eaves. A home can pass a five-foot clearance check and still have openings that let embers in. Our guide to how homes actually burn in a wildfire explains why those building details matter.
These are California rules. They do not directly govern Nevada properties, though the same five-foot logic applies to homes in Incline Village or Zephyr Cove. California-side Tahoe owners in South Lake Tahoe, Truckee and Tahoe City should watch for how their local authority applies the final text.
What this means for your home
You do not need to wait for the vote to start. These steps make sense under almost any version of the final rule:
- Walk the first five feet. Clear leaves and needles from the roof edge, gutters and the base of walls. Our five-foot ember-resistant zone guide has a room-by-room checklist.
- Move combustibles. Relocate firewood, doormats, planters with woody shrubs and stored items away from the house, and clear the space under decks and stairs.
- Look at fences and gates. If a wood fence or gate touches the house, plan for a noncombustible section. Check with your local fire authority before you rebuild anything.
- Know which zone you are in. Our defensible space zones explainer covers Zones 0, 1 and 2. Whether your address falls under State or Local Responsibility Area rules changes what applies to you.
- Close the ember doors. Vents, gutters and eaves are not covered by Zone 0 alone. Look at ember-resistant vents and gutters.
- Document what you do. Dated photos and receipts help if you later apply for a Wildfire Prepared Home designation. The California Department of Insurance reported on September 18 that State Farm's filing to reopen would be limited to homes with certain IBHS Wildfire Prepared Home designations. That filing remains under state review. Your carrier sets final pricing and eligibility.

Frequently asked questions
Is Zone 0 in effect right now?
No. The Board adopted the regulations on August 19, but they must be approved by OAL and filed before they take effect. The package was withdrawn from OAL for edits and is expected back before the Board on November 5.
Do I have to remove trees or tear out landscaping?
Not based on what the Board has described. Zone 0 targets combustible items, debris and certain plant arrangements in the first five feet. Wildfire Los Angeles notes there are practical steps you can take without removing healthy trees or established landscaping. Check your local fire authority for your property.
Will following Zone 0 lower my insurance premium?
We cannot promise that. Some carriers consider defensible space and home hardening in underwriting, but your carrier sets final pricing. Ask your agent or carrier which documentation they accept, and keep records of the work you complete.
